Dear Ms. Neulander:

 Thank you for contacting me regarding medical marijuana.  You will be pleased to know that I am a cosponsor of H.R. 2835, the Medical Marijuana Patient Protection Act.

            As you may know, H.R. 2835 would end marijuana's classification as a Schedule I drug and allow physicians to prescribe it for medical use under applicable state law.

            Twelve states currently allow the medical use of marijuana when prescribed by a doctor.  However, these laws have proven ineffective in the past due to federal laws criminalizing the possession and use of the drug.  On June 6, 2005, the United States Supreme Court ruled that federal authorities may prosecute individuals who use marijuana for medical purposes, regardless of their state’s laws.  In 2009, Attorney General Eric Holder said despite this ruling the Justice Department would not use federal resources to prosecute patients who use medical marijuana in compliance with their state’s laws.  While this was an important announcement, Congress must go further to ensure that this treatment option is permanently available to patients in all states.



H.R. 2835 is currently before the House Committee on Energy and Commerce.
